The purpose of these Terms of Use is to provide information on the Terms of Use of the System to the Customer and to determine obligations of the Customer and Forum Cinemas with regard to the use of the System. When registering with the System, the Customer shall be required to get appropriately acquainted with the Terms of Use. The Customer confirms that the data submitted during registering with the System and further on are true, valid, and complete. In the case of submission of false data, Forum Cinemas is entitled to terminate the Agreement unilaterally.
Account – the Customer account in the System where information about the customer transactions in the System and purchases made is stored.
Forum Cinemas – Forum Cinemas OU branch in Latvia with the single registration number 40203221668, the registered office: 13 janvāra iela 8, Riga, LV-1050, e-mail: kino@forumcinemas.lv.
Customer – the recipient of the Forum Cinemas service and/or purchaser of Goods, a natural person who has confirmed electronically that s/he agrees with the Terms of Use and has registered with the System.
Username – a unique name chosen by the Customer that s/he uses when logging in the System so that s/he can be identified in the System.
Terms of Use – the present Terms of Use of the System.
Agreement – a distance agreement between Forum Cinemas and the Customer on the use of the System, based on the Customer’s registering with the System.
Password – the Permanent Password selected by the Customer, which s/he uses when logging in the System.
Goods – cinema tickets offered by Forum Cinemas.
Registration with the System – filling out the registration form, entering the required data, accepting the Terms of Use and data processing privacy policy, and a set of other actions that are a prerequisite for using the System.
System – Forum Cinemas Online Customer Self-service System, which is available on the website www.forumcinemas.lv and provides the possibility for the Customers to purchase cinema tickets online and obtain information on the films exhibited in the film theatre.
1.1 As part of the present Agreement, the Customer orders and Forum Cinemas commits to connect the Customer with the System and provide System-related services to the Customer, but the Customer agrees to use the System in accordance with the present Terms of Use.
2.1 Individual Customer registration takes place electronically by accepting the Terms of Use and data processing privacy policy.
2.2 The Customer is identified in the System by Username and Password if the Customer logs in directly online.
2.3 The Username and Password chosen by the Customer are confidential information which the Customer and Forum Cinemas agree not to disclose to third parties and prevent third parties from learning and/or using.
2.4 System-related services are available 24 hours a day:
2.4.1 unless encumbered by circumstances independent from Forum Cinemas;
2.4.2 unless System maintenance works or works related to the improvement of the System are performed.
2.5 Forum Cinemas has right to change the terms of the present Agreement by sending an informative e-mail to the e-mail address provided by the Customer. If the Customer does not agree to changing the terms of the Agreement, the Customer shall have the right to terminate the Agreement by activating the Termination of Agreement reference included in the e-mail. Thus, by terminating the Agreement, the Customer's account is deleted, but the Customer is entitled to receive the previously purchased and unused cinema ticket.
2.6 The Customer can receive information on the services available in the System and the procedures for providing them, as well as the applicable Terms of Use, in accordance with the procedures set out in the paragraph 8 .3.
3.1 The customer undertakes:
3.1.1 when registering with the System, to provide genuine information and promptly notify Forum Cinemas of any changes in the information provided;
3.1.2 to keep safe any sensitive information related to the use of the System;
3.1.3 to ensure that his/her equipment (computer) complies with the minimum requirements for the receipt of the System services;
3.2 The Customer is responsible for the correctness of the e-mail address selected and specified in the System and for accessibility and securing his/her e-mail.
3.3 By agreeing to these Terms of Use, the Customer confirms that s/he is informed about the processing of personal data performed by Forum Cinemas, as set out in these Terms of Use and privacy policy, and agrees with it.
3.4 The Customer has the right:
3.4.1 to verify the conformity of the Goods before payment for the Goods;
3.4.2 to send to Forum Cinemas information about the observed imperfections or inaccuracies in the System;
3.4.3 to exercise without hindrance the rights established by the laws and regulations of the Republic of Latvia.
4.1 Forum Cinemas undertakes:
4.1.1 to identify the Customer in the System in accordance with the present Terms of Use;
4.1.2 to ensure the provision of services related to the System and the sale of Goods to the Customer in accordance with the present Terms of Use and the laws and regulations of the Republic of Latvia;
4.1.3 following the purchase of tickets, to send immediately to the e-mail address specified by the Customer electronic cinema tickets and invoices;
4.2 Forum Cinemas is not responsible if the Customer does not receive the information sent by Forum Cinemas to the email address provided by the Customer. The information is considered to have been sent to the Customer at the moment it was sent.
5.1 The present Agreement shall enter into force after the Registration of the Customer with the System and shall be valid for an indefinite period of time.
5.2 The Customer has right to terminate the Agreement unilaterally by notifying Forum Cinemas in accordance with the procedure laid down in Paragraph 8.3. In such case, Forum Cinemas has the right to request additional Customer information from the Customer.
5.3 Forum Cinemas closes access to the System and terminates the Agreement within 5 (five) working days from the receipt of the Customer's application.
5.4 Forum Cinemas has right to unilaterally terminate the present Agreement:
5.4.1. without delay and warning in case the Customer violates the present Terms of Use.
6.1 Forum Cinemas shall not be liable for any damages incurred to the Customer in case any third party connects to and/or uses the System using the Customer Username and Password.
6.2 The Customer shall be responsible for any operation in the System performed using his or her Username and Password.
7.1 When registering with and/or using the System, the Customer shall provide to Forum Cinemas personal data, which Forum Cinemas processes for the following purposes:
7.1.1 To meet the contractual obligations between the Customer and Forum Cinemas on the delivery of Goods within the System as requested by the Customer, as well as to respond to the questions and requests submitted by the Customer;
7.1.2 To improve the quality and supply of Goods and services, and to improve the functioning of the System and the Customer's experience in using it through the Customer satisfaction surveys and research;
7.1.3 To send personalized information to the Customer about similar Goods or services, promotions, or other campaigns provided by Forum Cinemas, based on the Customer's purchases and activities in the System.
7.2 When processing the Customer’s personal data, Forum Cinemas undertakes to comply with the laws and regulations governing the protection of personal data.
7.3 Forum Cinemas shall not transfer the Customer data to any third parties, except other companies of the Forum Cinemas Group, if this is necessary in connection with the improvement of the System or integration of the System and the centralizing of functions at the Group level.
7.4 Forum Cinemas shall not transfer the Customer data to a country that is not a member of the European Union or European Economic Area, unless the data recipient provides a level of data protection corresponding to the level of data protection required by the legislation of the Republic of Latvia.
7.5 In case the Customer does not want to receive information in accordance with the Paragraph 7.1.3 of the present Terms of Use or in case the Customer has other questions about the processing of personal data performed by Forum Cinemas, please contact Forum Cinemas using the contact information specified in the present Terms of Use.
7.6 The personal data processing and privacy policy is available here: https://www.forumcinemas.lv/privacy
8.1 The documents produced electronically shall have the same effect as the written documents.
8.2 The electronic consent of the Customer to the present Terms of Use shows that the Customer is fully familiar with, understands and agrees to the provisions of the present Agreement.
8.3 The Customer can get a more detailed description of the services available in the System, request the ticket purchase history, announce of unilateral termination, and address other issues related to the present Agreement as follows:
8.3.1. By visiting the “feedback” section of the www.forumcinemas.lv website of the System;
8.3.2. By calling the informative premium rate phone number 1189;
8.3.3. By writing e-mail to the address kino@forumcinemas.lv.
8.3.4 To delete the account, send an e-mail to privacy@forumcinemas.lv.
8.4 The electronically concluded Agreements between the Customer and Forum Cinemas are not maintained on the Forum Cinemas website.
